By placing an order, you confirm that you have read these Terms, which you accept without reservation.

The user accepts that:

  • You may only use this website to make inquiries or orders that are legitimate.
  • You will not place orders that are speculative, false or fraudulent in nature. If we have reasonable grounds to believe that an order is of such a nature, we reserve the right to cancel the order and inform the appropriate authorities.
  • You are obligated to provide a correct and complete e-mail address, postal or other contact details and you agree that SweetCare may contact you using those details should it deem it necessary.
  • If you do not provide SweetCare with all the information SweetCare deems necessary, it may not be possible to complete your order and/or guarantee a quality service.
  • By placing an order through this website, you represent that you are over 18 years of age and have the legal capacity to enter into contracts.

 

The information contained in these Terms does not constitute a sale proposal, but a mere invitation to negotiate. No contract regarding the mentioned products will be established between SweetCare and the user without the order being accepted by the user (regardless of whether or not a debit has been made to the user's account). If the order is not accepted after any debit has taken place in the user's account, the respective amount will be refunded in full.

To place an order, you must follow the online purchase process and activate the "CONFIRM ORDER" button. You will then receive an email confirming that your order has been received by SweetCare (the "Order Confirmation").

Without prejudice to the provisions of clause 9 “PRICE AND PAYMENT”, you should note that this does not mean that your order has been accepted. The order constitutes only an offer to purchase one or more of our products.

Any order is subject to its acceptance by SweetCare, which will always be confirmed by sending an email communicating the shipment of the product(s) - Shipping Confirmation.

The contract of sale between you and us (Contract) will only be formalized with the communication of the Shipping Confirmation. The Contract will only concern the products mentioned on the respective invoice.

Information on this website may contain typographical errors or inaccuracies and may not be complete or up to date. The carriers with whom we have protocols deliver from Monday to Friday, between 9 am and 6 pm, at the address you indicate for delivery.

We inform each customer of the expected date of final delivery, subject to the availability of products in store. Products in stock or with deferred delivery, which have payment confirmation within 24 hours after placing the order, count for this calculation.

It is the customer's duty to review the reported date to adjust the approximate expectation of final delivery to the customer.

Track my order

When your order is shipped, you will receive a code in your e-mail so that you can locate it on the website of the carrier of your choice. If you have difficulties tracking your order, please contact us at suporte@sweetcare.pt.

Order return

In case of return to SweetCare Lda. in the absence of collection within the stipulated period or absence of taxes payment when applied (applied by your country customs), the costs of this return will be charged to the customer, that is, the value of the return postage is deducted from the value of the eventual reimbursement to the customer + any customs fees if applicable.

 

SweetCare will not be responsible, before the user or any third party, for the withdrawal of any product that appears on this website, for the alteration or elimination of any materials or contents of this website, or for the refusal to complete the processing or to accept any order that has been object of shipment through the “Order Confirmation” procedure.

 

You, as a consumer, may freely terminate the Contract within 14 days from the date of delivery of the products to the place and person of your choice. In this case, the user will be refunded the full price paid for the products, in accordance with the Return Conditions (see clauses 12 and 13 below).

The right to terminate the Agreement will only take place if the products are returned in the same condition in which they were received by the user. The customer must return it with all instructions, documents and packaging materials. Any product that is damaged, that is not in the same condition in which it was received by the user, or that has signs of use beyond the mere opening of its packaging may be returned, in which case the user will not be entitled to any refund. relating to its acquisition.

Please take due care in handling the product(s) while in your possession and keep the original boxes, instructions, documents and other packaging materials for possible return and collection of the products.

More detailed information about the right to terminate the contract and explanations regarding the respective exercise are the subject of clause 12 of these Terms. This provision is without prejudice to any rights resulting from the law.

 

As long as they are available (see clause 4 above), SweetCare will make every effort to ensure that, except in exceptional circumstances, the products included in a Shipping Confirmation are delivered to the user within the announced deadline, or if there is no indication thereof, within 15 days from the date of the Order Receipt Confirmation.

Possible reasons for the delay include:

  • The customer did not provide a contact number – mandatory field, as imposed by carriers;
  • Specialized products;
  • unforeseen circumstances;
  • elivery area;
  • Wrong or incomplete delivery address

If, for any reason, SweetCare is unable to deliver on the scheduled date, the user will have the option to keep the order, by extending the delivery period, or to proceed with its cancellation against a full refund.

For the purposes of these Terms, a "delivery" is considered to have been made or a product is considered to be "delivered" upon receipt of delivery by the carrier at the agreed address.

 

From the moment of delivery, the risks relating to the product supplied will be borne by the user.

Ownership of the products supplied will only be transferred to the user when SweetCare has received full payment of the amounts due for the supply of the product, including delivery charges, or after delivery, whichever happens later.

 

www.sweetcare.com offers a conversion service for several currencies. This service is provided as an indicator only. Your purchases are always debited in euros.

Except in case of obvious error, the price of the products will be what is indicated at all times on our website. Although SweetCare seeks to ensure that all prices indicated on the website are correct, errors may occur. If SweetCare finds that the price of a product included in an order is wrong, it will inform the user as soon as possible, giving him the possibility to choose between reconfirming the order at the correct price or canceling it. If it is impossible to contact the user, the order will be canceled and the user will be refunded for the total amount of the order, if he has already paid for it.

SweetCare will have no obligation to supply any product at an incorrect price (if lower), even if a Shipment Confirmation has already been issued, if the error is obvious, unambiguous and should have been identified by the user in reasonable circumstances.

The prices indicated on this website include VAT (when applicable), but do not include delivery costs, which will be communicated and added to the final price.

We reserve the right to refuse orders based on their size or value. All prices and quantities available are subject to change at any time, but, except as stated above, this change will not affect orders for which a Shipment Confirmation has already been issued.

When the user has completed their orders, all the products they wish to purchase will be placed in their shopping cart, the next step will be to select the delivery method and make the payment. For this purpose you must:

Pursuant to the rules and regulations in force, purchases made through this website are subject to Value Added Tax (VAT). The Portuguese VAT rate is applied to orders placed by private consumers residing in Portugal or any other country in the European Union.

Orders placed outside European Union, are Tax Free and exclude the Portuguese VAT rate.

In orders outside the European Union customs fee may be charged in the country of destination in accordance with the laws in force in that country. It's payment is the full responsibility of the customer.

 

In case of lack of conformity of the good with the contract, the user is entitled to have it replaced free of charge, by means of repair or replacement, an appropriate price reduction or termination of the contract, within a maximum period of 30 days.

The user may exercise the rights provided for in the previous paragraph, when the lack of conformity is manifested within a period of two days from the delivery of the good.

 

General rule for returns

If you wish to return a product purchased under the terms set out in this document, you must send an email to suporte@sweetcare.pt, expressly requesting the return.

You must return the product in the same packaging used for the first delivery. Whenever possible, you should accompany the product to be returned with all original boxes, labels, documents and packaging materials. SweetCare will inspect the returned product. Any product that has been damaged, is not in the same condition in which you received it or shows signs of use beyond the simple opening of the package, does not confer the right to contract resolution and refund.


Return of defective products

If you believe that the product supplied upon delivery is not in conformity with the Contract, you should promptly contact SweetCare via email at suporte@sweetcare.pt informing us of the state of the product and its defects.

SweetCare will inspect the returned product and inform you of your right to a replacement or refund (if any) via e-mail within a reasonable time. SweetCare will normally provide a refund or replacement as soon as possible and in any event within 14 days of confirmation via email that you are entitled to a refund or replacement of the defective product. Products returned by you because of a defect, if confirmed to be defective, will be refunded the full amount paid, including delivery charges and return postage. The refund of any amount paid will always be made via the discount voucher or payment method used to purchase the product (subject to customer preference).


Refund

The refund will take place as soon as possible, on average 4 working days after receipt of the returned items in our warehouse (in any case, within 14 days from the date of receipt of the items in our warehouse). The refund of any amountco will always be done through one of the following ways:

SweetCare Ltd. informs that, in order to enable the consumer to exercise the Right of Withdrawal, the user must expressly inform this withdrawal request in writing via email to support@sweetcare.pt.

The user has the right to freely terminate this contract within 14 calendar days, without giving any reason. (except for products made to your specification or custom made)

The period for exercising the right of free resolution expires 14 days from the day following the day on which you acquire or a third party indicated by you, other than the carrier, acquires physical possession of the goods.

In order to exercise your right of free termination, you must communicate to us, SweetCare Lda., via the email support@sweetcare.pt, your decision to terminate this contract by means of an unequivocal statement (for example, letter sent by post, fax or email).

Free resolution effects

In the event of termination of this contract, you will be refunded all payments made, excluding delivery costs, without undue delay and, in any case, no later than 14 days from the date on which we are informed of your decision. termination of this contract.

We may withhold the refund until we have received the returned goods, or until you provide proof of shipment of the goods, whichever comes first.

You must return or deliver the goods without undue delay and no later than 14 days from the day on which you inform us of the free termination of the contract. The deadline is considered to have been respected if you return the goods before the 14-day deadline has expired.

You must bear the direct costs of returning the goods.

It is only responsible for the depreciation of the goods that results from a handling that exceeds what is necessary to verify the nature, characteristics and functioning of the goods.

The user must return the product in the same packaging used for the first delivery or similar secure packaging. The user must accompany the product to be returned with all original boxes, labels and packaging materials, as well as offers and samples. SweetCare will inspect the returned product. Any product that has been damaged, that is not in the same condition in which the user received it or that shows signs of use beyond the simple opening of the packaging, does not give the right to withdraw from the contract and refund.

 

SweetCare respects your privacy. Any and all information collected on the website will be kept confidential and will not be sold, provided or reused by third parties without your authorization. Any information provided to us will be treated with care and used for the sole purpose of executing your order and improving your experience on our website.

 

The user acknowledges and accepts that all intellectual property rights relating to any and all material and content that are part of this website remain at all times the property of SweetCare or its licensors.

All brands, services related to brands and labels (collectively referred to as "Brands") are the property of Sweetcare, Lda or their respective owners who grant Sweetcare Lda the right and license to use the respective brand.

The user is permitted to use said material only to the extent expressly authorized by SweetCare or its licensors. This does not prevent the user from using this website to obtain a copy of an order or the terms of the Agreement.

 

Applicable legislation requires that some of the information or communications that SweetCare sends to users be in written form. By using this website, the user accepts that the communication between him and SweetCare is mainly electronic. SweetCare will contact you by email or provide you with information by posting notices on this website. For contractual purposes, you accept this electronic means of communication and acknowledge that any contracts, notices, information and other communications that SweetCare transmits to you electronically satisfy the legal requirement that such communications be in writing. This provision is without prejudice to any rights of the user, which result directly from the law.

 

All communications from the user to SweetCare must be sent via the email addresses mentioned in this document. Without prejudice to the provisions of clause 16, SweetCare may communicate with the user either by email or by post to the address contained in the order.

To prove that a communication has been sent, in the case of postal delivery, it is sufficient to prove that the respective letter was correctly addressed, sealed and delivered by post and, in the case of sending by email, that the same email was sent to the address email address indicated by the user.

 

The Agreement between SweetCare and the user is binding on the parties and their respective successors and assigns.

The user may not transfer, assign or encumber his contractual position, or by any other means dispose of the Agreement or any rights or obligations arising therefrom, without SweetCare's prior written consent.

SweetCare may transfer, assign or encumber its contractual position, sub-contract or otherwise dispose of the Agreement or any rights or obligations arising therefrom, at any time during its term. However, no transfer, assignment or encumbrance of such position, or act of disposal of the contract, may have the effect of limiting the legal rights of the user as a consumer or reducing, or limiting in any way, any guarantee provided by SweetCare to the user of express or implied form.

 

SweetCare shall not be liable for failure to perform, or delay in performance, of any obligation under the Agreement that is due to an event beyond its reasonable control ("Force Majeure Event").

A Force Majeure Event comprises any event, act or omission beyond SweetCare's reasonable control and includes, in particular (but not exclusively), the following:

  • Strikes, lock-outs and other labor actions
  • Civilian uprisings, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat of war preparations.
  • Fire, explosion, storm, flood, earthquake, sinking, epidemic or other natural disaster.
  • Impossibility of using rail, sea, air, road or other public or private means of transport.
  • Impossibility of using public or private telecommunications networks.
  • Government laws, decrees, regulations or restrictions.
  • Any strikes, interruptions or accidents affecting relevant postal or transport services.

SweetCare's obligation to comply with any Contract will be suspended for the duration of a Force Majeure Event and will give rise to an extension of the respective term equivalent to that duration. SweetCare will make reasonable efforts to put an end to a Force Majeure Event, or to find a solution that allows the fulfillment of its contractual obligations despite the existence of a Force Majeure Event.

 

If SweetCare, at any time during the term of the Agreement, refrains from demanding strict compliance with any obligation arising from the Agreement or these Terms for the user, or from exercising any right or faculty provided therein to put an end to such non-compliance, this will not constitute a waiver of those rights and faculties and will not exempt the user from fulfilling his obligations.

SweetCare's waiver of the exercise of any right or faculty, in the face of a given situation of non-compliance by the user, does not mean waiver of rights or faculties in the face of a subsequent non-compliance situation.

SweetCare's waiver of any right resulting from the Agreement or these Terms will only be effective if it appears in a written communication sent to the user in the manner provided for in the Communications clause, where the user expressly declares that he waives.

 

The declaration of invalidity, illegality or ineffectiveness, by a competent authority, of any of the provisions of these Terms & Conditions will not affect any of the remaining provisions, which will continue in full force.

 

These Terms and any document referred to therein constitute the entire agreement between the parties regarding the formation of a Contract and supersede any previous agreement, understanding or arrangement, in written or oral form.

Both parties acknowledge that, when entering into the Agreement, neither of them based their respective motivation on a statement, commitment or promise made by the other, or that could be considered implicit in anything that had been said or written in negotiations that took place between the parties at a time prior to the conclusion of the Agreement, unless otherwise stated in these Terms.

Neither party can take advantage of the fact that the other has made an untrue statement, whether oral or in writing, prior to the conclusion of a Contract (unless such statement has been made with fraud) and can only rely on the rules of non-compliance contractual agreement resulting from these Terms.

These Terms and any document referred to therein constitute the entire agreement between the parties regarding the formation of a Contract and supersede any previous agreement, understanding or arrangement, in written or oral form.

Both parties acknowledge that, when entering into the Agreement, neither of them based their respective motivation on a statement, commitment or promise made by the other, or that could be considered implicit in anything that had been said or written in negotiations that took place between the parties at a time prior to the conclusion of the Agreement, unless otherwise stated in these Terms.

Neither party can take advantage of the fact that the other has made an untrue statement, whether oral or in writing, prior to the conclusion of a Contract (unless such statement has been made with fraud) and can only rely on the rules of non-compliance contractual agreement resulting from these Terms.

 

SweetCare has the right to change these Terms of Service at any time. The user is subject to the principles and terms in force on the date of his order, unless the law or competent authority imposes any changes to them (and such changes are applicable to orders already placed).

 

 

The provisions of this clause do not prevail over any legal rights of the user as a consumer.

Delivery time

Your order will be shipped as soon as all items are available.

When all items are in stock, orders are shipped the same day, or the next day depending on the time and payment method chosen. Otherwise, they will be shipped within the maximum period indicated in the out-of-stock items.

Orders are processed on working days of the Portuguese national calendar. Orders for delivery in Mainland Portugal processed before 15:00 GMT are usually shipped the same day. When processed after this time, they are shipped the next business day.

Delivery times can be extended in periods of high flow of objects, as is the case of holiday periods, Christmas and Black Friday.

Situations of retention of orders at customs for inspection, exceptional situations of airspace restriction, pandemic or other similar and unavoidable situations, can affect delivery and/or return times.

We ship worldwide. If you cannot find your country in the list of countries on the shopping bag, please contact us and ask for a quote.

SweetCare is governed by the legislation and marketing authorizations in force in Portugal and is not responsible for shipments of substances that are not authorized to be marketed at the place of delivery. In these cases:

If the shipment is made via Portuguese Post and is automatically returned, for reasons of not authorizing the entry of the goods in the country of destination, after receiving the returned order in our store, we will refund the value of the products deducted of any Portuguese customs fees. applied, in the form of a discount voucher.

If the shipment is carried out by express courier, the return of the order implies a charge to the customer (transport + possible customs fees for imports in Portugal). If the value is accepted, it is deducted from the refund value of the products in the order (via discount voucher). For reasons of customs performance, in some exceptional destinations, the possibility of opting or not for the return is only given. It is automatically carried out and the cost is borne by our customer.

For shipments by express mail, the postage value indicated on the shopping bag is only indicative. This value is only confirmed at the conclusion of your order, after entering the delivery address.

After the order is dispatched, situations in which the address needs to be changed due to insufficient/incorrect address or different from the one initially requested, imply the charge of a fixed amount of €12 to the customer.

Although infrequent, in specific cases, the customer may have to go to the nearest post office to pick up the order.

Tracking

As soon as we ship your order, you will receive by email the tracking number that will allow you to follow the delivery status.

 

Safe

All shipments are covered by insurance against loss. In case your order is lost, SweetCare will refund the entire order or make a second shipment at no additional cost. The order can only be considered lost after confirmation by the carrier.

 

Customs Duties and Taxes in the European Union

No additional taxes or customs duties are charged for items that are shipped to European Union countries. Item prices and shipping costs include VAT and are therefore listed as gross prices.

 

Customs Duties and Taxes OUTSIDE THE EUROPEAN UNION

All taxes, customs duties and customs fees resulting from shipment are the responsibility of the customer. All items are shipped DDU – Delivery Duties Unpaid.

In addition, any additional fees or shipping costs not previously authorized will be deducted from the customer's refund.

When can I return or exchange an item?

Returning an item is quick and easy. You just have to ensure that the item meets the following conditions:

Within a maximum period of 14 days from the date of purchase;

We do not exchange or return orthopedic products or underwear.

 

Do I have to pay anything to return or exchange the item?

In the case of returning items that do not show any manufacturing defects, the cost of return is the responsibility of the buyer.

4. The refund will be made using the same payment method used in the original order or via a discount voucher, as soon as the return is received and validated in our warehouse.

IMPORTANT - For returns from countries outside the European Union:

1. Send an email to support@sweetcare.pt to request a return

2. In this e-mail informs:

- Bill number

- Description and reference of the item(s) to be returned

- Amount you want to return

- Reason for return

3. You will receive an email from our customer service and, in case of approval, you will receive an email validating this return.

All fees and customs duties resulting from the return are the responsibility of the buyer. Any additional fees or transportation costs not previously authorized will be deducted from the refund.

Returns made without prior express authorization (via email) may not be accepted and have a fixed cost plus €3 handling cost.

 

REFUNDS

When returning items, will I receive the shipping costs?

When returning the entire order, the total value of your order will be refunded, excluding shipping costs (unless the return is motivated by non-conformities of the article).

If the delivery of the order to the customer is not successful due to lack of cooperation on the part of the customer (wrong telephone number, wrong address, absence at the address, non-compliance with local legislation, etc.), it will be returned to SweetCare with expenses borne by the customer (including any fees and customs duties). These fees will be deducted from any refund.

 

Unfortunately, we cannot process direct exchanges for items purchased online and returned to our warehouse. You will have to return the item(s) for a refund and make a new purchase in our online store for the alternative item.

 

At SweetCare the health and safety of our customers always come first. SweetCare owns the Parapharmacy (OTC online store) License Nr. 00044/2022*, under the local authority Infarmed. SweetCare is allowed to sell pharmaceutical products, cosmeceuticals, and nutritional products and exclusively sells approved brands and 100% genuine products certified and subject to the control of Infarmed, the National Authority of Medicines and Health Products in Portugal.
